On August 8, 2018, Elon Musk, high flying CEO of Tesla, Inc. tweeted to the world that he was considering taking Tesla private at $420 per share. He said he had the money. The price of the stock skyrocketed, trading was temporarily suspended and the SEC launched an investigation into potential price manipulation. The financing later appeared to have depended on inconclusive conversations with the Saudi government. Some securities lawyers began to consider the impact of Musk’s tweeting on Tesla stock investors, including those who might be invested through their 401k plans. Within a week of Musk’s surprise announcement, several investors had filed Tesla stock lawsuits, claiming that they had suffered financial losses as a result of market manipulation.

Potential Lawsuit: Vaginal Rejuvenation Lawsuit News and Legal Information

On July 30, 2018, the United States Food & Drug Administration (FDA) issued a formal warning to manufacturers of laser gynecological devices and patients who have undergone, or plan to undergo, treatment with such devices. The FDA initially cleared these “energy based” devices for the treatment of serious health conditions, including cancer and hysterectomies. However, after reviewing reports of problems and the results of several studies, the agency has issued a stern warning against the use of these devices for “off label” purposes—including vaginal rejuvenation. Although these devices have been approved for the treatment of serious health conditions, the FDA has not approved their use for the treatment of other conditions for which they are being used. Seven device manufacturers have been targeted with warning letters, and the FDA has requested their feedback before deciding what actions, including potential enforcement actions, are appropriate.

The drug Valsartan (a generic version of Diovan), which is prescribed to treat high blood pressure and prevent heart failure, has been recalled worldwide after it was found to contain N-nitrosodimethylamine (NDMA), a known carcinogen. Valsartan contamination from a Chinese manufacturing plant may date back to 2012, potentially exposing many patients to Valsartan cancer risk, liver damage and tumors. It has been on the market for 15 years.

Potential Lawsuit: Insurance Company ER Services Denial Lawsuit Information

Several insurance companies are refusing to cover emergency room visits, telling their policy holders/patients that they must pay for emergency services if the insurer deems the ER visit “unnecessary”. This new policy began with Anthem Insurance Company, which decides whether to pay an emergency room bill based on a doctor’s diagnosis — not the reason the patient went to the hospital. Health experts say this new policy will scare patients away from emergency departments – patients who could potentially have a life-threatening condition. Insurance attorneys are filing complaints against such insurers, claiming they violate federal and state law.

Potential Lawsuit: Intragastric Balloon Surgery Lawsuits Legal News and Lawsuit Information

Intragastric balloon lawsuits are now taking shape after a dozen deaths were attributed to the recently-approved form of weight-loss surgery. As of June 2018, the Food and Drug Administration linked 12 deaths to the implantation of what appears to be a defective medical device. The most recent reports implicate the Orbera Intragastric Balloon, manufactured by Apollo Endosurgery Inc. and the Integrated Dual Balloon, which is manufactured by ReShape Lifesciences. Similar devices are manufactured by Obalon Therapeutics and Spatz Medical.
