Jacoby & Meyers has been helping injured victims across the country recover compensation for damages caused by taking the defective drugs Yaz and Yasmin, birth control medications manufactured by Bayer HealthCare Pharmaceuticals, Inc. Ocella is the generic alternative to Yaz and Yasmin and is manufactured by Barr Pharmaceuticals. Ocella came onto the market in 2008 and was prescribed for birth control and for the off-label purposes of alleviating the symptoms of premenstrual dysphoric disorder (PMDD) and treating acne. The FDA only approved Ocella for the prevention of pregnancy.

How Ocella came to the market is quite the legal story. Barr had sued Bayer over patent rights regarding Yaz and Yasmin. Ultimately, after a series of hearings and judicial decisions, the federal courts invalidated the patents on Yaz and Yasm, which opened the door to Ocella to be sold in the United States after obtaining FDA-approval. Ocella soon encountered the very same problems as Yaz and Yasmin.

Injuries Caused by Yaz/Yasmin and Ocella

Yaz, Yasmin, and Ocella are different from other birth control pills. Like many birth control pills, they are a combined hormonal pill, with two different hormones, a progestin and an estrogen. The progestin used is unique, and so are its effects. Yaz is approved and marketed for contraception and treatment of moderate acne and PMDD. However, the unique hormone that causes the positive side effects of Yaz, Yasmin, and Ocella may also be responsible for dangerous injuries or death among users.

Yaz and Yasmin have been linked to an increased risk of blood clots, heart attack, and stroke since 2002. Ocella contains the same active ingredients and therefore is likely to result in similar risks. Other serious side effects associated with these birth control pills include:

  • Liver damage
  • Depression
  • Migraines
  • Breast lumps
  • Unusual vaginal bleeding
  • High blood pressure
  • High cholesterol
  • Allergic reactions (rashes, hives, itching, swelling, wheezing, difficulty breathing or swallowing)
  • Gallbladder disease
  • Pancreatitis

Overpromotion by Bayer HealthCare Pharmaceuticals

In October 2008, Food and Drug Administration (FDA) issued a letter to Bayer HealthCare Pharmaceuticals warning that two of their television ads were untrue. Specifically, Bayer was accused of marketing Yaz for PMS, a condition for which it had never been tested or proven to treat.

In addition, the letter warned that the Yaz TV ads understated and minimized the serious risks associated with the use of this potentially dangerous drug.
The FDA has received reports of more than 50 deaths associated with the consumption of Yaz and Yasmin.
