Wrongful Death Lawsuits Comprised of Two Types of Legal Claims
Generally, wrongful death lawsuits are made up of two separate and distinct types of claims. The first type of claim is actually referred to as a “wrongful death” cause of action. A wrongful death cause of action is an action brought by a spouse, child or parent of a wrongful death victim for the damages they personally suffered. While each state’s Wrongful Death Statute differs in some respects, the statutes typically authorize family members who are authorized to bring a wrongful death claim to recover damages for the following:
- Loss of financial support
- Emotional distress and mental anguish
- Loss of companionship and services of a spouse (loss of consortium)
- Loss of guidance of a parent
The other type of claim that is usually brought in the same lawsuit with a wrongful death cause of action is called a “survival action”. This type of action is designed to compensate victims of careless or intentional misconduct who would have had a right to bring a personal injury lawsuit had they survived. The wrongful death accident victim in a survival action has a right to compensation for the damages, injuries and loss that the accident victim could have sought in a personal injury accident. These damages include:
